Terms of Use

Introduction

Contracting parties: These terms of use ("Terms") apply between the Swedish company: SmakShare AB with company registration number: 559353-6385 (hereinafter referred to as "we" or "us") and the individual who uses the application "SmakShare" or "RecipeMind" (hereinafter referred to as "you"). SmakShare AB and the User are hereinafter collectively referred to as the "Parties" and separately as the "Party".

Approval of the Terms: By registering a User Account to the Application, you accept the applicable Terms and enter into an agreement with us, and you should therefore make sure that you read the Terms carefully before using the Application.

Electronic communication: You hereby agree that we have the right to communicate electronically with you, regarding the Application and/or your User Account, by email and/or through the Application.

Definitions

• Application: refers to the application "SmakShare" or "RecipeMind" for iOS and Android.
• User: refers to individuals who use the Application.
• User Account: refers to an identity in the Application that identifies a User and gives the User access to the Application's features.
• User generated content: refers to all content that is registered or published in the Application by Users.
• Third-party: refers to any legal or natural person, other than the User or SmakShare AB.
• GDPR: Regulation (EU) 2016/679 (General Data Protection Regulation).

The Application

SmakShare and RecipeMind: SmakShare and RecipeMind are recipe applications that you can use to easily save and share your recipes. RecipeMind is made for an English-speaking audience, and SmakShare for a Swedish-speaking audience. The apps simplify meal planning and grocery shopping.

The Application may not be used in violation of the Terms or applicable law, or for other purposes than those for which the Application is intended.

Fees: Certain features of the Application are available only through a paid subscription. The free version includes limited functionality. We may change these limitations over time.

Visible content

There are some information and content that may be visible to all Users, for example:

• Information registered in a User Account: name, profile picture and description.
• The number of followers a User has, including a list of the followers.
• The number of Users that a User follows.
• Which Users have saved another User's recipe.
• User's registered comments on public recipes.

However, there are some things that you can choose to make public or not, for example:

• Your Instagram-account or a link to your website/blog.
• A recipe that you upload. If public, it will be visible to other Users and may be shared.

Messages

Users can message each other through the Application. Users are solely responsible for their own actions. All use of the messaging function is at the User's own risk. Users are not permitted to use the messaging feature to perform any illegal, misleading or harmful act. We reserve the right to block the messaging feature for Users who violate the Terms and/or terminate a User Account.

Permission

You are solely responsible for ensuring that all recipes/images and other content that you upload do not contravene any applicable law and do not infringe the intellectual property rights of any Third-party.

User generated content

You are solely responsible for your User generated content and that it is correct, legal and does not violate these Terms or Third-party rights. You shall indemnify us fully against all claims made against us due to such content. We have the right, but no obligation, to modify/adjust/delete any content at any time.

Third-party services

The Application does use Third-party services that declare their own terms and conditions.

Affiliate links

We reserve the right to include affiliate links in our posts on our Website, in the Application and within the Service. We also reserve the right to remove affiliate links published by other Users.

By using our Application, Website, or Service, you acknowledge and agree that some of the links available on these platforms may be affiliate links. The decision to use or not use affiliate links is entirely up to you as a User. We disclaim any responsibility for claims, issues, damages, or losses that may arise in connection with the use of affiliate links.

Use of the Application

Login information

Your email address must be correct. The login information must be handled with confidentiality and you are responsible to keep your phone and access to the Application secure. We recommend that you do not jailbreak or root your phone.

Use of the Application

We cannot take responsibility for the way you use the Application. When you are using it, bear in mind that although we endeavor to ensure it is updated and correct at all times, we do rely on Third-parties to provide information to us.

Internet access

You are responsible for possessing the equipment, internet connection and software required. Standard rates for data traffic may apply. Certain functions will require an active internet connection.

Warranties and forbidden actions

You hereby warrant that you will not:

• use the Application contrary to its purpose or in a way that causes damage,
• make a copy of the Application,
• decompile or attempt to ascertain the function of the software or "hack" it,
• register any sensitive personal data,
• misuse any information retrieved from the Application,
• register or publish any content that is racist, illegal, inappropriate, abusive or offensive,
• copy or modify the Application or our trademarks,
• attempt to extract the source code, or
• try to translate the Application or make derivative versions.

Terminate your User Account

You can delete your User Account at any time through the user panel or by contacting us at info@smakshare.se.

Violations

In the event of your violation of the Terms, we reserve the right to terminate your User Account with immediate effect. We also reserve the right to take legal action.

Intellectual property rights

The Application and all intellectual property rights attributable to it are owned by SmakShare AB. We do not transfer any intellectual property rights to anyone else. We do not claim ownership of any User generated content.

Anonymized data

We have the right to anonymize your personal data and all other data generated from your use of the Application, and to freely use, publish and share anonymized data for commercial, non-commercial, marketing and/or editorial purposes without restriction.

Right of use

When you register/upload a recipe, you can choose to make it private or public. If you make it public ("Public content"), you give other Users the right to use, share, publish and republish the Public content within and outside of the Application.

You also give us the right to share, publish and republish the Public content on our website and/or social media accounts, for commercial and marketing purposes. We will list you as the source.

You can change between public and private at any time.

Request for deletion

If we have published any of your Public content and you want it deleted, contact us at info@smakshare.se.

No compensation

You accept that you have no right to claim any compensation for uploading/registering recipes/images in the Application.

Support and maintenance

Updates

You agree that we may from time to time release updated versions of the Application. You must install the latest version. The Terms in force also apply to updates.

Maintenance

We strive for the Application to be available 24/7. However, there may be technical complications. We have the right to take measures that affect availability for technical, maintenance, operational or safety reasons, without prior notice.

Remedy

We shall try to remedy any errors or deficiencies in the Application, if possible, to the best of our ability and within a reasonable time.

Logging

We may use logging of the use of the Application for troubleshooting, investigating abuse, analyzing intrusions and improving the Application.

Processing of personal data

We process personal data in accordance with the GDPR. More information can be read in our Privacy Policy.

Limitation of liability

Errors: Incorrect information may appear and we reserve the right to correct discovered errors.

Third-party applications: We are not responsible for any Third-party applications, plugins, products, information or similar.

Disclaimer: You are solely responsible for your use of the Application. We disclaim, to the extent permitted by applicable law, all liability for direct and indirect damages incurred in connection with the use of the Application.

Grounds for exemption: Each Party is exempt from liability for failure to fulfill contractual obligations if hindered by force majeure circumstances (epidemic, pandemic, government decision, strike, fire, war, natural disasters, etc.).

Invalidity of provisions

Should any provision be found invalid, it shall not affect the validity of the other provisions.

Changes

We have the right to change the design, layout and content of the Application at any time, without prior notice. We may also stop providing the Application at any time. Upon termination, the rights and licenses granted to you will end and you must stop using the Application.

Some changes may take effect immediately. Other material changes will take effect no sooner than 30 days after we have informed you. Continued use after changes constitutes your acceptance. These Terms are effective as of 8 October 2025.

Assignment

We have the right to transfer the Terms, in whole or in part, to other companies within our group or to Third-parties without your consent. You may not transfer any rights or obligations.

Applicable law and dispute resolution

The Terms shall be governed by Swedish law. Disputes shall in the first instance be settled directly between the Parties. If not resolved, the dispute shall be finally settled by a general court in Sweden.

Consumers have the right to turn to the National Board for Consumer Disputes (ARN, www.arn.se) or the European Commission's Online Dispute Resolution platform.
